就我所了解的,如果要QUALIFY那个TREATY的话,你必须是resident of China,

好像f-1到了五年,你可以按照resident alien来保税,也可按照NR来报,而且我们怎
么都算

you come to U.S. to get J-1 visa.
Also, if you hold a J-1 visa, you have exempt for more than 2 years of the
proceeding 6 years, you are resident alien.
But I also notice some exceptions, see this article

Who pass the substantial presence test may also choose to be nonresident
alien by using Form 8840.
Treaty Article 19 is for J-1, there is no expand rule.
Article 20 is for F-1, there is expand rule.
So to my understanding, F-1 still is qualified for treaty no matter you are
resident alien or not. But J-1 is not qualified for this special treatment. |
