Thank you for contacting my office regarding your concern for Senate
Constitutional Amendment 5. Yesterday, Senator Ed Hernández withdrew SCA 5
from further consideration. As introduced in the California State Senate,
SCA 5 proposed to place an amendment to the California Constitution on a
future California ballot.
The constitutional amendment envisioned by SCA 5 would have impacted the
operation of public education. Currently, the state is prohibited from
discriminating against or granting preference to certain groups of
individuals. SCA 5 would have eliminated this prohibition as it relates to
the operation of public education.
Since my first engagement with the public on this issue on February 21st, I
have engaged myself in a deep study of the issues raised by SCA 5. I find
these issues to be very complex and worthy of a thorough, thoughtful, and
measured debate and discussion. California needs to have a conversation
about how to help all of our children achieve success.
Concurrently with the announcement of the withdrawal of SCA 5, the
leadership of the California State Legislature announced the formation of a
task force to study the issues that were raised by SCA 5.
I was not going to be able to support SCA 5 this year as it was presented,
so I applaud both the decision of Senator Hernández and the formation of
the task force.
Since February 21st, I have received hundreds of communications about this
measure. I appreciate the intensity of the concerns that has been expressed
about SCA 5.
We must understand how best to advance educational equality and opportunity.
I hope that the task force will provide the forum for this important
statewide conversation. I appreciate you contacting me regarding this
important issue. I hope that you will continue to engage with my office on
issues of concern for the 24th Assembly District and the state at large.
