a new company. Didn't file AC21 as hope not to trigger my case to get audit.
But still unfortunately, USCIS sent a notice asking me to provide EAD card
and Employment letter from I140 Petitioner (should be my previous company.).
Now I can only provide Employment letter from my current. Now I have the
same title, very similar job description.
Would this be a concern that I didn't file AC-21?
It seems they still check af |

have your current employer to file ac21 that will work. make sure DOL job
code remain the same.

-140 as the "prima facie evidence of such intent". The below is from USCIS
memo in 2005.
Question 8. Can an alien port to self-employment under INA §204(j)?
Answer: Yes, as long as the requirements are met. First, the key is whether
the employment is in a "same or similar" occupational classification as the
job for which the original I-140 petition was filed.
Second, it may be appropriate to confirm that the new employe

发帖数: 25 | 9 NSC. I certainly left after 140 got approved and 485 more than 180 days.
Actually my 140 got approved at end of 2007. Then my H1B was expiring in
2009, my previous company didn't want to extend H1B as it costs more than
EAD. So I had EAD instead of H1B at the end of 2008. In 2009 I changed my
job without filing AC21.
My attorney did contact me with AC21 check list. and there are many docs I
need prepare for filing AC21 even, so I skipped.
Anyone remember the results of similar case from last yea |
