以下是我们律师写的rider, 然后被卖家律师删掉了。 请问对方这样做是不是合理的?
b) there are no issues regarding the stability or structural soundness of
the foundation and/or pilings of the Premises;
c) there is no mold existing at the Premises;
d) the premises does not contain any asbestos;
e) there are no active leaks in the premises roof or otherwise
8. PERMITS AND APPROVALS. Seller represents that any and all
improvements and/or renovations completed or commenced during Seller’s
ownership of the premises have been completed pursuant to duly issued and
approved permits and condominium association approval where required. The
provisions of this paragraph shall survive the delivery of the deed.
12. CONFLICTING PROVISIONS. In the event that this Addendum conflicts
with the provisions contained in the standard form Purchase & Sale Agreement
or any other addendum hereto, the provisions of this Addendum shall control.
15. MEDIATION/ARBITRATION. Buyer and Seller agree that any dispute
arising out of this Agreement which cannot be resolved in good faith between
the parties shall be submitted for at least three (3) hours of mediation to
REBA Dispute Resolution, a subsidiary of the Real Estate Bar Association
for Massachusetts. Mediation sessions shall be conducted within seven (7)
days of the date on which mediator receives a request for mediation from
either the Buyer or Seller, and any agreement resolving the dispute signed
by the Buyer and Seller shall be binding. In the event the parties cannot
reach an agreement, despite mediation sessions, the Buyer and Seller agree
to submit the dispute to binding arbitration. The arbitration shall be
conducted by an arbitrator selected by REBA Dispute Resolution, or an
arbitrator as the parties may agree. The costs and fees associated with
such alternative dispute resolution shall be shared equally by the Buyer and
Seller.
18. Risk of loss shall remain with SELLER until delivery and recording of
the deed.

Second that. The sellers can disclose the issues (b. c. d. e. especially c,d
,e) are unknown to them if they do disclose on them. It is up to the buyers
to find it out (yes, inspection, the purpose of the inspection is to verify
what sellers disclose and what they don't including things unknown to them.
If they do exist, you can ask them to be addressed or you can quit). For
structural and safety issues, it is also on basis of knowing it or not.

B,c,d,e去掉意味着seller makes no representation knowing anything about these
aspects. If I were the seller, I would do the same. It is up to the buyers
to find out if there is any problem. The fact you are moving forward with
the P&S suggests you take the house as is in these aspects.

再给你举个例子,我卖房子时天气还不冷,所以不能查地暖。买家问我这个系统是否
work,我知道work,但回复是:我不知道现在是否work, 我去年用时是work的。因为这
个系统很贵,我不想保证任何东西。最后买家take as is了。

楼主不知道是什么情况。有时候律师可能是应客户的不断要求,烦了或者干脆是偷懒懒
于解释,写上去让seller side来辩驳,这样反而容易给客户作解释。
也不排除没有经验的paralegal写上去的。律师出漏子的情况是会发生的,尽管一般不
会是这类的问题,

你的律师不是Sonja Selami 吧? 她是我见过的最不靠谱的律师. 感觉很有她家风格。
这家律师事务所真的是奇葩中的奇葩。 除了套模版,什么用都没有。

这个罗马尼亚女的,做事没底线。 唯利是图。只要有钱赚就行。根本不在乎甚至不惜
牺牲客户利益. 根本没有任何原则。
