1、都是F1超过5年。
2、我去年1月CPT，5月OPT，10月H1，一直是Full Time工作。公司发了W2。去年1月份
原来学校还发给我部分前年12月份的工资，但到现在还没有收到W2或者1042-S。
3、我LP去年全年学生，收到了学校发的W2。到目前没有收到1042-S，但是W2上的
Salary已经是减掉5k Treaty的了。
考古后，我觉得我也符合5k Treaty，所以我们Resident Joint Filling, 要填1040和
8833。
我的问题是：
1、要填多少份8833？
2、以后若收到1042-S，要寄过去吗？若有了1042-S，还需要寄8833吗？
3、确实是寄到1040NR的地址，而不是1040的地址吧？

long form，可是填那个long form还有牵涉到先填schedule CA(540NR)的问题，填就填
吧，认真研究instruction发现，在COLUME A里还要连带把federal的信息也填了，但是
填federal时我们用的是1040NR-EZ，这在instruction里没有怎么办啊（只有1040NR或
者1040EZ的填写说明）？
其实我在12年就是个part-time job的，那个W2 FORM里都没有扣我的州税，这样看的话
，我们是不是可以不用这么麻烦填long form了呢？只填short form，让老公用head of
household可不可以呢？
不知道写明白了没有，恳请各位帮忙看看，跪谢！ |

什么？

Background:
Wife: EB2, prior date: Sep 2013; filed I-140 and I-485 in Aug 2015.
Husband: EB2, prior date: Dec 2013; filed I-140 in Aug 2014 and been
approved, will file I-485 in Oct 2015.
Under such case, two questions:
1. Can wife file another I-485 with the husband case? If could, what to do?
2. If wife did file I-485 with husband in Oct 2015, can she later file I-485
with her husband in the future, if her I-485 been rejected, she changed a

我的140是NSC处理的 以为还要直接寄到NSC 但是刚刚在USCIS网站上看到我对应的I485
filling address是 USCIS Phoenix， AZ
考古了一下好像确实是这个地址没错 也就是说Phoenix 处理速度会比较快？ 还是说
Phoenix会把case再转给NSC？
Phoneix 貌似只是个field office. NSC 才是 service center。有点混乱 麻烦大家指教 |

办完退税了。美国犹太老头会计师很肯定地把我的NIW 的律师费claim在1040 schedule
A 中的23项：attorney and accounting fee。该数值-1040中38项的2%可以填在27项
中。尤其在我告诉他IRS的人（ID#为10025720xx)在电话中回答yes后更是犹太式地笑着
说：相信我，没错吧。
老头说他的许多意大利客户都申报了这一项。只要可以解释为该律师费是为了让你得到
更多的income就是符合申报条件滴。。。汇报完毕。 |
