现在因为个人原因提前终止合同，公寓让付了两个月的租金作为buyout fee，然后我就
付了。
后来又收到公寓的信说因为我提前终止了合同所以免费的那个月房租也得补上。
我一直以为buyout fee include everything了。也怪自己buyout时候没要个docu证明
所有fee都clear了。请问怎么才能和公寓argue？ |

发帖数: 25 | 12 今天去了几家dealer，其中一家GM dealer给了接近我心里底线的otd price。本来一切
都准备好了，但是我签字之前突然发现他们的路线是。
1，我先付信用卡＋支票给dealer
2，两周内，Ally Bank将会给我寄lease monthly payment通知
3，我带着这个通知去dealer，dealer将会付清余款给Ally bank, 然后把title转给我。
dealer的解释是，GM现在有lease车的incentive, 要给我这个比其他dealer低很多(~$
2000)的OTD price, 他们需要通过lease and buyout的方式提供低价。
我以前买过新车，知道常见trick但是对lease完全不懂，记得版上有人说过如果不懂
money factor, residual value等名词，lease车就是被宰。
不太爽在签约前才被告知是这样一回事，最终我没有签约，因为实在吃不准背后的风险
，比如将来我要不要承担另外的税，有没有潜在费用，保险怎么办等等。
还有，如果照dealer所说的，这个等价于买车，那么其不是人人都可以通过这种方式去

现在在edmund和kbb查的价格，private party大概是20-21 k，dealer大概是22-23 k
这种情况是不是应该buyout？很奇怪为什么当初dealer估计的residual value比今天的
实际市场价格低这么多。中间有什么蹊跷吗？

3000多块。真心舍不得，请大家支招。
去年的合同是今年6月底到期，需要续租，公寓此前都是住满一年后可以短期合同，当
时也问过短期合同的事，但是跟我说对于我只能最短到明年三月份，而且要每个月多付
100多块钱。然后可以再短期到明年6月底。考虑这种短期没有意义就选择了12个月的合
同，当时email联系，知道提前搬家有罚金的事，可是当时想那就住满一年再搬家。谁
知道现在因为工作变动要搬家，尝试和公寓协调少付罚金，理由是已经住满一年了，给
别人做短期合同而给我的短期合同没有意义。现在协调未果。公寓给了一个buyout
agreement， 但是这个agreement上面只有他们签字，没让我签字。这种情况下，如果
不付钱就离开会有什么严重后果？还有其他的方式吗？

考虑的一些因素有：
license是non-exclusive还是exclusive? non-compete还是compete?
买家是否有sub-license的权利？
买家能从中获得多少商业利益？
照片的稀有度：是否不买你的照片他还能找到很多类似的替代品？
当然其实最终的价格基本上还是看买家有多财大气粗来决定。。。。GettyImage的价格
能参考一下。但不少买家不愿意出Getty的价格，因为他是直接买你的照片，你可以全
数拿到而不像Getty那样只能拿到15%-20%。所以卖家往往会觉得出不到Getty的价你实
际到手的也比从Getty卖多，是个双赢局面。 |
